NOTIFICATION ICTSG DISCIPLINARY COMMITTEE KHALIL AHMED KHAN-The President International Council of Traditional Sports and Games (ICTSG) under the power vested in him vide Article 7(b)(vii)(x)(xii) of the approved Statutes of ICTSG and the Special Resolution signed by the Member States and participants during the 4th Collective Consultation Meeting on safeguarding and promotion of TSG, UNESCO has been pleased to constitute ICTSG Disciplinary Committee with composition and Terms of Reference as given Under:- Terms of Reference: The Terms of Reference (TORs) of the Disciplinary Committee (the “Committee”) shall be as follows: a.    The DISCIPLINARY COMMITTEE shall consist of members appointed by the President ICTSG, representing a diversity of Member States to uphold impartiality and adherence to international standards in disciplinary proceedings. b.    Members of the DISCIPLINARY COMMITTEE shall be appointed based on their experience, integrity, and commitment to the principles upheld by ICTSG and UNESCO, including fairness, respect for traditional sports, and cultural diversity. c.    The Committee is mandated to ensure the integrity of ICTSG Statutes, Byelaws and Rules for dealing with matters referred to it for disciplinary action as result of Inquiries, Complaints and Reports initiated/proceeded against any officials, member organization, or individuals. d.    The Committee shall have the authority to investigate, hold hearings, and issue rulings on matters involving breaches of ICTSG’s Code of Conduct, Statutes, and Rules by any official, member organization, or individual associated with ICTSG. e.    Referrals may also include violations of UNESCO-aligned values, including the respect for cultural heritage, safety, and integrity in traditional sports and games. f.    The Committee shall investigate, held hearings, and issue Rulings on only such matters which have been referred by President ICTSG to it. The Committee may provide advisory opinion and recommendations to the President ICTSG/Executive Board on disciplinary  cases. g.    The DISCIPLINARY COMMITTEE has the authority to take interim measures, such as suspension or conditional participation, pending the resolution of disciplinary matters where immediate action is necessary to protect individuals or the integrity of the sport, however such action shall be notified to all concerned. h.    To hold meeting of ICTSG Disciplinary Committee as and when the complaint/matters are referred to it by the President. i.    Upon receipt of the reference/written complaint the Committee Shall: i)    Establish a procedural timetable to be followed for completion of the inquiry;ii)    Notify the accused party of the charges and statement of allegations leveled against them/him, the formal written receipt of which will be given;iii)    Request the accused party to submit a written defense. On the accused party’s failure to do so without any reasonable/valid cause, the Committee shall proceed ex-parte; andiv)    the Committee shall enquire into the charge and may examine such evidence, while preferring documentary evidence as being primary however, if need arises oral evidence can also be taken into consideration being secondary evidence in the matter after intense scrutiny of the same.v)    Where deemed necessary, the Committee may retain independent experts, investigators, or legal counsel to assist in the disciplinary process, including interviewing witnesses, analyzing evidence, and providing guidance on complex matters.vi)    Hearings may be held in person or via remote means, depending on the needs of the case and logistical considerations. j.    The detailed report on the activities and findings of each ICTSG Disciplinary Committee shall be submitted to ICTSG Secretariat (Head office) within Ten (10) days of each meeting, ensuring transparency and adherence to international standards in disciplinary matters  k.    The Committee shall uphold principles of natural justice in all proceedings. The standard of proof in all determinations shall be based on the balance of probabilities as is in any criminal proceedings. l.    The COMMITTEE can impose any such measures as it deems necessary on the Respondent to ensure that the matter concerned is not repeated, the safety of those involved in the Sport is protected and that the integrity and good reputation of the Sport is maintained. The Committee may impose multiple sanctions in relation to a disciplinary matter at its entire discretion. The COMMITTEE and the Head office shall retain a record of all sanctions and decisions made by the DISCIPLINARY COMMITTEE. m.    When determining any sanctions the DISCIPLINARY COMMITTEE shall, without limitation, have regard to:i.     the seriousness, scope and nature of the disciplinary matter;ii.    the extent to which the disciplinary matter was deliberate or reckless;iii.     the general compliance history of the Respondent, and any specific history of the disciplinary matter in question; and iv.    the responsiveness and conduct of the Respondent in relation to the disciplinary matter in question.v.     All COMMITTEE members are required to disclose any potential conflicts of interest regarding a case before the Committee. Members with conflicts must recuse themselves from related proceedings.vi.     The COMMITTEE shall ensure that all parties involved in disciplinary matters are treated with respect and that proceedings are conducted free from harassment or discrimination. Subject to these Rules, the Committee’s proceedings shall remain confidential. Both the parties and the Committee agree to maintain the confidentiality of all documents and materials produced in connection with the disciplinary matter, except where disclosure is legally required, necessary to pursue or protect a legal right, enforce or contest a bona fide legal award, or where such materials are already publicly available (excluding disclosure in breach of this confidentiality agreement). n.    All individuals contacted by the Committee in connection with an investigation are obligated to cooperate with the Committee. o.    The Committee shall conduct disciplinary proceedings in such a manner as it deems appropriate.
